Terms of Use

GoLegal.ca (“GoLegal”) is an online website provider of certain specific legal products and services (the “GoLegal Services”). GoLegal provides GoLegal Services subject to the following conditions. By using GoLegal Services, you agree to these conditions. Please read them carefully. References to “you” and “your” means any user of this site, whether or not the user is a customer or has made a purchase of the GoLegal Services.

Privacy

Please review our Privacy Policy, which also governs your use of GoLegal Services.

Electronic Communications

oLegal uses E-mail as its primary mode of communications with you. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Copyright and Trademarks

All content included in or made available through the GoLegal website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of GoLegal and is protected by Canadian and international copyright laws. In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through the GoLegal website are trademarks of GoLegal, and may not be used in connection with any product or service that is not GoLegal’s without the express written permission of GoLegal.

Limited Licence

Subject to your compliance with these Terms of Use and your payment of any applicable fees, GoLegal grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of GoLegal Services. This licence does not include, among other things, any resale or commercial use of any GoLegal Service or its contents, unauthorized use of the website content, data mining, or any similar or related activity. All rights not expressly granted to you in these Terms of Use or any Service Terms are reserved and retained by GoLegal

Conveyance of Products

GoLegal will send your products to you by E-mail, to the address provided to us by you. It is your obligation to ensure that you have provided us with the correct E-mail address. Please contact us if you believe that you have not received the purchased product within the time frame specified in your product order confirmation.

Cancellations, Returns and Refunds

Once an order has been processed, GoLegal will only be able to cancel and refund a transaction which has not already been reviewed and/or worked on by a member of the GoLegal team. Products which have been completed and sent to you cannot be refunded. Please also note that corporations created in your name cannot be refunded or cancelled. You must speak to your personal lawyer or accountant about the process of dissolution. A corporation must be duly dissolved in accordance with Ontario law, otherwise it will endure regardless of use, and you will remain liable for obligations such as income tax filings.

Pricing

All listed GoLegal prices do not include any and all applicable taxes, government fees, access fees and any and all related or ancillary disbursements, unless otherwise stated. Due to the relatively fast turnaround time of our orders, your credit card will be charged once you confirm your order.

Disclaimer of Warranties and Limitation of Liability

THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC'S CONSUMER PROTECTION ACT, DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MIGHT NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

GOLEGAL SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE AMAZON SERVICES ARE PROVIDED BY GOLEGAL ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. GOLEGAL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF GOLEGAL SERVICES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH GOLEGAL SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. BY USING GOLEGAL SERVICES YOU UNDERSTAND THAT, SHOULD YOU HAVE ANY QUESTIONS ABOUT ANY GOLEGAL PRODUCTS, IT IS YOUR OBLIGATION TO RETAIN COUNSEL TO OBTAIN AN OPNION ON SAID PRODUCTS.

Applicable Law and Disputes

Any dispute or claim relating in any way to your use of any GoLegal Service, or to any products or services sold or distributed by GoLegal or through GoLegal Services will be resolved by alternative forms of dispute resolution, including negotiation, mediation and binding arbitration, rather than in court, except that we or you may assert claims in small claims court if your claims qualify. The Canadian Federal Arbitration legislation will apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Use as a court would.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.
